Capacity Pro Group Privacy Policy

Capacity Pro respects your privacy. This policy explains what personal information we collect, how we use it, and the choices you have.

In this policy, "Capacity Pro", "we", "us", and "our" mean Capacity Pro Group Limited (CPG - a New Zealand HQ/ company) and its operating companies and joint ventures, including:

  • Capacity Pro New Zealand Limited (CPNZ)
  • Capacity Pro Australia Pty Ltd (CPAU)
  • Mentor Link cc t/a Capacity Pro South Africa (CPZA - joint venture)

Capacity Pro Group Ltd is the group data controller. Where you deal with one of our operating companies (“OpCo”), that entity is responsible for your information locally, in line with this policy and applicable local law.

The information we collect

We aim to collect only the information we genuinely need.
The main categories are:

  • Contact information - name, job title, employer, email, phone number, location (if/ where onsite or hybrid work is a factor).
  • Project information - details you or your organisation share with us in the course of an engagement, including correspondence, proposals, statements of work, and project deliverables.
  • Candidate information – Resume/ CVs, employment history, qualifications, references, and/or similar details where you are a candidate being represented or considered for a role and/or resource requirement for a project.
  • Website information - basic technical information when you visit our website, such as IP address, browser type, pages viewed, and information you submit via contact or enquiry forms.

We don't intentionally collect sensitive information (such as health, ethnicity, or political views). If we do receive it - for example, dietary requirements for an event, or information contained in a resume/ CV - we treat it with extra care and only use it for the purpose it was provided.

How we collect it

We collect personal information:

  • Directly from you, when you contact us, engage our services, share a resume/ CV or proposal, attend an event, or subscribe to our updates.
  • From your employer or company/ client, where we are providing services to them.
  • From publicly available sources, such as LinkedIn or company websites.
  • Automatically, when you use our website (see Cookies below).

Why we use it

We use personal information to:

  • Deliver our services to clients and candidates.
  • Communicate with you about projects, proposals, opportunities, and enquiries.
  • Manage our relationship with you, including invoicing and record-keeping.
  • Improve our services and website.
  • Send you updates or marketing communications you've requested and/or agreed to receive (you can unsubscribe at any time).
  • Comply with our legal obligations.

We do not sell your personal information.

Who we share it with

We share personal information only where it is necessary, and only with parties who are required to protect it. This may include:

  • Our group companies and joint ventures listed above, where they are involved in delivering services to you.
  • Clients and candidates, where sharing is part of the engagement (for example, sharing a candidate's resume/ CV with a prospective client).
  • Service providers who help us run our business - including cloud hosting, IT, email, document storage, and professional advisors.
  • Regulators, courts, or law enforcement, where required by law.
  • A buyer or successor, if our business or part of it is sold or restructured.

Storing information outside your country

We use cloud-based systems and group resources that may store or process your information in countries other than the one you live in - including New Zealand, Australia, South Africa, the United Kingdom, and other countries where our providers operate. Wherever your information is held, we take reasonable steps to ensure it is protected to a standard consistent with this policy and applicable law.

Your rights

You have the right to:

  • Access the personal information we hold about you.
  • Correct information that is inaccurate or out of date.
  • Unsubscribe from marketing communications at any time.
  • Complain to us if you're unhappy with how we've handled your information.

If you live in a country with specific privacy laws - such as New Zealand (Privacy Act 2020), Australia (Privacy Act 1988), South Africa (POPIA), or the United Kingdom (UK GDPR) - you also have any rights provided under those laws. We'll honour those rights when you contact us.

If we can't resolve your complaint, you can also contact your local privacy regulator - for example, the Office of the Privacy Commissioner in New Zealand (privacy.org.nz).
